Indefinite Leave to Remain in UK for non-EU?

HI, I'm going to complete my 5 years stay in UK soon(I've got a 5 years Residence Permit) and my spouse has EU citizenship whilst I have a non-EU one. So the question is, when applying for ILR do both of us need to apply or I can apply just by myself? Since in theory my spouse does not require ILR because of having EU citizenship.
